The Mozambican government is in the final phase of drawing up regulations for the Mining and Oil laws, the Permanent Secretary of the Ministry of Mining Resources said in Maputo, according to reports.
“After the adoption of laws and tax regimes by Parliament in August and September this year, we are now completing the drafting of the regulations, which should be ready by the end of this year,” commented Mozambique’s Mining Resources Ministry spokesperson Alfredo Nampete.
Harmonising mining legislation
Mozambique sees a need to harmonise the mining legislation with the principles adopted in the regulations of harmonisation of sectorial policies within the Southern African Development Community (SADC).
According to the country’s Permanent Secretary, the regulation is being drawn up with the assistance of mining and oil sector operators, as well as with civil society.
The legislation applicable to mines governs the use and benefit of mineral resources (with the exception of oil) and lays down the licensing procedure for mining activities, both of which are monitored by the Ministry of Mineral Resources (MIREM) and by the National Directorate of Mines (DNM).
Government stake in projects
The Government of Mozambique’s revision of the Mining Law is mainly based on the state identifying projects in strategic sectors, such as coal mining, in which it seeks to have a share.
In addition, the Mining Law revisions will be adjusted to the new dynamics of the mining industry in Mozambique. This entails being able to respond to some of the concerns arising out of the necessity to attract investment for the internal production and processing of mineral products.
Also, the revision seeks to reserve the Mining Certificate for the undertaking of mining activities of small scale, exclusively for national citizens.
Environmental classification of mining activities will be adjusted accordingly with the environmental legislation in the new law.
